Instructions Regarding Claiming Template Spreadsheet

These instructions explain how to use the spreadsheet available at http://www.googlebooksettlement.com/r/enter_spreadsheet_claim to identify and claim books and to manage settings for claimed books.

Before reviewing these instructions, please be sure to review the Notice, which is available at http://www.googlebooksettlement.com/notice.html for important information regarding the Settlement Agreement. Identifying and Claiming Books

There are three ways to use the template spreadsheet to identify and claim books:

  1. Upload an ONIX file of books
  2. Manually enter information about books in the spreadsheet
  3. Provide an ISBN prefix or list of publisher names/imprints



How to Identify and Claim Books Using an ONIX File

  1. Upload the ONIX file at http://www.googlebooksettlement.com/r/enter_spreadsheet_claim.

  2. The following columns on the spreadsheet will be filled in automatically to the extent the information is contained in the ONIX file:

    1. Column B: Identifier type
    2. Column C: Identifier value
    3. Column D: Title
    4. Column E: Author or other contributor
    5. Column F: Imprint
    6. Column H: Publication year
    7. Column L: Work for hire
    8. Column S: Do you consider this book Commercially Available?


  3. The following columns will be filled in based on information provided by Google:

    1. Column P: Digitization status (book has been digitized or may be digitized on or before May 5, 2009 without authorization)

    2. Column Q: Is the book currently designated as "Commercially Available" under the Settlement?

    3. Column R: Conflict: An "X" will appear in this column if Google's and your information regarding the status of a book as Commercially Available is conflicting. Note that this column can only be filled in if you provide the information requested in Column S.

    4. Note: When you upload an ONIX file, by being provided with a pre-populated spreadsheet with the information in Columns P and Q, you are attesting to the following statement: "This ONIX file consists of information kept in the account holder's ordinary course of business about one or more of the account holder's books."


  4. Download the pre-populated spreadsheet by following the instructions on the next screen.

  5. To claim books, publisher claimants must:

    1. Fill in the following columns if they are empty:

      Either

      1. Column C: Identifier value;

        or

      2. Column D: Title and Column E: Author or other contributor

    2. Fill in or leave blank Column L: Is this book a work for hire? If you leave this column blank, the book will be treated as not a work for hire.

    3. Fill in one of the following two columns:

      1. Column M: Highly Confident that rights have not reverted; or
      2. Column N: Confident that rights have not reverted

  6. To claim books, claimants other than publishers (authors and agents) must:

    1. Fill in the following columns if they are empty:

      Either

      1. Column C: Identifier value;

        or

      2. Column D: Title and Column E: Author or other contributor

    2. Fill in Column O: Have the rights reverted to you, your predecessor in interest, or your client from the publisher?

  7. You may fill in any of the columns labeled as optional at this time.

  8. Go to http://www.googlebooksettlement.com/r/enter_spreadsheet_claim to upload the completed spreadsheet.

  9. Check the certification at the bottom of that page.

  10. Click the button marked "Upload and claim books."

  11. Review the confirmation screen. You will receive further instructions regarding books that could not be claimed.

  12. To download a spreadsheet listing all of your claimed books that will include information regarding whether each book has been digitized (or Google reasonably anticipates that it might digitize it on or before May 5, 2009) without authorization and whether it is designated as Commercially Available or not Commercially Available, please go to http://www.googlebooksettlement.com/r/view_claims.




How to Identify and Claim Books by Manually Entering Information

  1. Download a blank spreadsheet template from http://www.googlebooksettlement.com/r/enter_spreadsheet_claim.

  2. To claim books, publisher claimants must:

    1. Fill in the following columns:

      Either

      1. Column C: Identifier value;

        or

      2. Column D: Title and Column E: Author or other contributor


    2. Fill in or leave blank Column L: Is this book a work for hire? If you leave this column blank, the book will be treated as not a work for hire.

    3. Fill in one of the following two columns:

      1. Column M: Highly Confident that rights have not reverted;

        or

      2. Column N: Confident that rights have not reverted

  3. To claim books, claimants other than publishers (authors and agents) must:

    1. Fill in the following columns:

      Either

      1. Column C: Identifier value;

        or

  6. Go to http://www.googlebooksettlement.com/r/enter_spreadsheet_claim to upload the completed spreadsheet.

How to Identify and Claim Books Using Search Terms

  1. Download a blank spreadsheet template from http://www.googlebooksettlement.com/r/enter_spreadsheet_claim.

  2. You must fill in:

    Either

    1. Column F: Imprint;

      or

    2. Column G: ISBN prefix

  3. Upload the spreadsheet at http://www.googlebooksettlement.com/r/enter_spreadsheet_claim.

  4. The following columns will be filled in automatically based on the search terms you submit, to the extent the information is contained in the search results:

    1. Column B: Identifier type
    2. Column C: Identifier value
    3. Column D: Title
    4. Column E: Author or other contributor
    5. Column F: Imprint
    6. Column H: Publication year


  5. Download the pre-populated spreadsheet by following the instructions on the next screen.

  6. How to Use the Spreadsheet to Manage Claimed Books

  1. Download a spreadsheet of all claimed books at http://www.googlebooksettlement.com/r/view_claims. That spreadsheet will have all relevant columns filled in based on information provided by you and Google, including whether each book has been digitized (or Google reasonably anticipates that it might digitize it on or before May 5, 2009) without authorization and whether it is designated as Commercially Available or not Commercially Available.

  2. Adjust settings by editing the information that appears in a column.

    1. Publisher claimants may:

      1. Adjust the title or author of a book by editing the information in Columns D or E, respectively. If you edit the title or author of a book, but no ISBN or LCCN is provided for the book, you may be claiming a new book, rather than editing the details of your previously claimed book. To ensure that you only have edited details for a book rather than claimed a new book, please review the information provided on the confirmation screen after you have uploaded your revised spreadsheet. (If you would like to abandon a claim that you previously submitted for a book, enter "Yes" in Column X and follow the directions below.);

      2. Adjust the Publication year in Column H;

      3. Adjust the status of a book as a work for hire by entering "Yes" or "No" in Column L, as appropriate;

      4. Change whether the publisher is Highly Confident or Confident that the rights have not reverted by entering "Yes" in either Column M or Column N, as appropriate;

      5. Indicate whether the publisher believes a book is Commercially Available by entering "Yes" or "No" in Column S, as appropriate;

      6. Initiate a challenge regarding Google's designation of a book as Commercially Available or not by entering "Yes" in Column T. Additional information regarding such challenge can be provided in Column U;

      7. Direct exclusion of a book from all Display Uses by entering "Yes" in Column V;

      8. Remove a book by entering "Yes" in Column W; or

      9. Abandon a previous claim by entering "Yes" in Column X.

    2. Claimants other than publishers (authors and agents) may:

      1. Adjust the title or author of a book by editing the information in Columns D or E, respectively. If you edit the title or author of a book, but no ISBN or LCCN is provided for the book, you may be claiming a new book, rather than editing the details of your previously claimed book. To ensure that you only have edited details for a book rather than claimed a new book, please review the information provided on the confirmation screen after you have uploaded your revised spreadsheet. (If you would like to abandon a claim that you previously submitted for a book, enter "Yes" in Column X and follow the directions below.);

      2. Adjust the Publication year in Column H;

      3. Adjust the client's name, mailing address or tax identification number by entering the appropriate information in Columns I, J and K, respectively;

      4. Indicate whether rights in a book have reverted by entering "Yes," "No" or "I don't know" in Column O, as appropriate;

      5. Indicate whether you believe a book is Commercially Available by entering "Yes" or "No" in Column S, as appropriate;

      6. Initiate a challenge regarding Google's designation of a book as Commercially Available or not by entering "Yes" in Column T. Additional information regarding such challenge can be provided in Column U;

      7. Direct exclusion of a book from all Display Uses by entering "Yes" in Column V;

      8. Remove a book by entering "Yes" in Column W; or

      9. Abandon a previous claim by entering "Yes" in Column X.

  3. Editing Column C will not result in abandoning a previously made claim for a book. If you entered an ISBN or LCCN that was incorrect and now wish to abandon a claim using the spreadsheet, you must enter "Yes" in Column X. If you edit Column C and enter a different ISBN or LCCN, the Registry will assume you are trying to claim a different book than the book you previously claimed.

  4. Additional options for managing books and Inserts are available under the Settlement. The Registry will notify you when you will be able to further manage your books and Inserts.

  5. After settings have been adjusted, go to http://www.googlebooksettlement.com/r/enter_spreadsheet_claim to upload the completed spreadsheet.

  6. Check the certification at the bottom of that page.

  7. Click the button marked "Upload and claim books."

  8. Review the confirmation screen to confirm that settings have been updated. If there is an error, you will receive further instructions regarding how to update the settings for claimed books.
